U.S. ELECTIONS ARE RECORDED ON HACKABLE ELECTRONIC VOTING MACHINES AND RECORDED BY PRIVATE CONTRACTORS, WHILE THE CORPORATE-OWNED "MAINSTREAM" MEDIA MAKE UP STORIES TO EXPLAIN UNEXPECTED OUTCOMES ...EVEN THOUGH THESE OUTCOMES ARE "STATICALLY IMPOSSIBLE" IN AN UNRIGGED ELECTION.

Wisconsin: None dare call it vote rigging
June 14, 2012

If vote-rigging prospers, none may call it vote-rigging. It simply becomes the new norm. Once again, the universal laws of statistics apply only outside U.S. borders. The recall vote in Wisconsin produced another significant 7% discrepancy between the unadjusted exit poll and the so-called "recorded vote." In actual social science, this level of discrepancy, with the results being so far outside the expected margin of error would not be accepted.

When I took Ph.D. statistics to secure my doctorate in political science, we were taught to work through the rubric, sometime referred to as HISMISTER. The "H" stood for an explanation of the discrepancy rooted in some historical intervention, such as one of the candidates being caught in a public restroom with his pants down and a "wide stance" soliciting an undercover cop. The "I" that came next suggested we should check our instrumentation, that is, are the devices adequately reporting the data?

Here's where U.S. elections become laughable. A couple of private companies, count our votes with secret proprietary hardware and software, the most notable being ES&S. Every standard of election transparency is routinely violated in the U.S. electronic version of faith-based voting. How the corporate-dominated media deals with the issue is by "adjusting the exit polls." They simply assume the recorded vote on easily hacked and programmed private machines are correct and that the international gold standard for detecting election fraud – exit polls – must be wrong.

They are not going to go through the rest of the acronym and check to see if the Sample makes sense, that the right Measurements are being taken, or whether or not there's been a breakdown in Implementing the exit polling. They won't check to see if the representative Size of the polling numbers are accurate, or if there are problems with the pollster's Technique, or if there was human Error, or if there's just bad Recording going on.

Of course, the machines could be recording wrong because they are programmed for an incorrect outcome. The easiest people to convince regarding the absurdity of electronic voting with private proprietary hardware and software are the computer programmers across the political spectrum. Statisticians and mathematicians also readily comprehend the obvious nature of rigged elections.

One of my favorite mathematicians is Richard Charnin, who on his website using readily available public information, calculates the odds of the so-called ‘red shift" occurring from the 1988 to 2008 presidential elections. The red shift refers to the overwhelming pick up of votes by the Republican Party in recorded votes over what actual voters report to exit pollsters.

In Charnin's analysis of exit poll data, we can say with a 95% confidence level – that means in 95 out of 100 elections – that the exit polls will fall within a statistically predictable margin of error. Charnin looked at 300 presidential state exit polls from 1988 to 2008, 15 state elections would be expected to fall outside the margin of error. Shockingly, 137 of the 300 state presidential exit polls fell outside the margin of error.

What is the probability of this happening?

"One in one million trillion trillion trlllion trillion trillion trillion," said Charnin.

More proof of Republican operatives and sympathizers is found in the fact that 132 of the elections fell outside the margin in favor of the GOP. We would expect eight.

Say you have a fair coin to flip. We would expect that if we flip that coin there would be an even split between heads and tails – or in this case, Republicans and Democrats. Election results falling outside the margin of error should be equally split between both parties. Yet, only five times, less than expected, did the extra votes fall in the direction of the Democratic Party.

So what are the odds? According to Charnin, of 132 out of 300 state presidential elections exceeding the margin of error in the direction of the Republicans – one in 600 trillion trillion trillion trillion trillion trillion trillion trillion trillion.

The corporate-owned media does not want to mention that the problems with the exit polls began with the ascendancy of the former CIA Director George Herbert Walker Bush to the presidency in 1988. It is also that year when the non-transparent push-and-pray voting machines were introduced in the New Hampshire primary by Bush ally John Sununu. Bush, who rigged elections for the CIA throughout the Third World did unexpectedly well where the voting machines were brought in.

In any other election outside the U.S., the U.S. State Department would condemn the use of the these highly riggable machines based on the discrepancy in the exit polls. It's predictable what would happen if an anti-U.S. KGB agent in some former Soviet Central Asian republic picked up an unexplained 5% of the votes at odds with the exit polls. A new election would be called for, as it was in the Ukraine in 2004. We would not have accepted the reported vote from the corrupt intelligence officer.

The CIA Director's son wins with laughable exit poll discrepancies in 2000 and 2004 and the mainstream media sees no evil. The media's perspective is to discredit the exit polls, which they sponsor, and call any who point to the polls "conspiracy theorists."

In 2004, 22 states had a red shift to the CIA Director's son, George W. Bush. Usually such improbably results are signs of a Banana Republic. Now we have a too-close-to-call neck and neck recall race in Wisconsin that show an obvious red shift for a right-wing red governor. Nobody wants to look at the non-transparent black box machines. Electronic election rigging has prospered. Long live the "adjusted" vote totals.

ELLEN BROWN EXPLAINS HOW GREECE, SPAIN, AND OTHER EUROPEAN NATIONS PRESENTLY BEING CRUSHED BY EXPONENTIALLY INCREASING NATIONAL DEBTS CAN *LEGALLY* RESTART THEIR ECONOMIES INSTANTLY, RESTORE EMPLOYMENT, AND WORK THEIR WAY OUT OF DEBT IN JUST A FEW YEARS

Greece and the Euro: Fifty Ways to Leave Your Lover

The problem is all inside your head she said to me
The answer is easy if you take it logically
I’d like to help you in your struggle to be free
There must be fifty ways to leave your lover.
–Lyrics by Paul Simon
The Euro appears to be a marriage of incompatible partners. A June 1st article in the UK Telegraph titled “Why Europe’s Love Affair with the European Project Is Ending” reported that two-thirds of 9,000 respondents thought that having the euro as their single currency was a mistake.

For Greece, it was a tragic mismatch from the beginning; and like many a breakup, it is really about money.  Greece is a vivacious young woman chained to a tyrannical old man.  She yearns to be free to dance on her own; but breaking up is hard to do.  Defaulting on her debts will force her out of the Eurozone and back to issuing drachmas, and she could get brutally beaten by speculators on foreign exchange markets for her insolence.

Fortunately, there are alternatives to an ugly divorce.  The treaties binding the 17 member nations are just a set of rules, entered into by mutual agreement; and rules can be bent or broken, especially in crises.  The ECB (European Central Bank) broke a litany of rules to save the banks, and so did the Federal Reserve to save Wall Street in 2008.  Rules that can be bent for banks can be bent for people and nations—not just Greece, but all the other Eurozone countries threatening to file for divorce.
Paul Simon says there are 50 ways, but here are five creative alternatives.

1.     The Open Marriage: Return to the Drachma Without Abandoning the Euro

James Skinner, former chairman of NEF (the New Economics Foundation in the UK), suggests that the Greek government could start issuing drachmas without abandoning the euro.  Drachmas could be reserved for domestic use—to pay the government’s budget, hire workers, build infrastructure and expand social services.  He writes:
Greece is suffering from a lack of money because the only source, the single currency, has dried up. But there is no law that states that there has to be only one currency.
. . . By enabling the Government, monitored by the Central Bank, to spend newly created money directly into the economy, bypassing the banking sector, the burden of increasing national debt can be avoided. . . .
This programme for creating a new Greek Drachma, bypassing the private banking sector, could start tomorrow. Its immediate effect would be to get the unemployed back to work. All existing Euro transactions can continue as before, quite separately from the new currency. The two currencies can perfectly well co-exist and run alongside each other. . . . Foreign banks will continue to deal in Euros and other currencies as usual.
This solution was successfully used in Argentina when its currency collapsed in 2001. The government walked away from its debts and started issuing its own Argentine pesos.  Three years after a record debt default on more than $100 billion, the country was well on the road to recovery.  Exports increased, the currency was stable, investors returned, unemployment diminished and the economy grew by 8 percent for 2 consecutive years.

2.  Separate Bank Accounts: Fire Up the Printing Presses at the Greek Central Bank

In a March 19 article on Seeking Alpha, George Kesarios observed that the Greek central bank has the power to issue more than just drachmas.  The ECB is not an ordinary central bank:
Rather, it is a confederation of central banks. Each European national central bank can theoretically do the same types of market operations as the ECB and then some. The forefathers of the euro have left many monetary windows open, which, if used correctly, can solve the European debt crisis in a very short period without taxpayer funds.
He cited article 14.4 of the Protocol on the Statute of the European System of Central Banks, which provides:
14.4. National central banks may perform functions other than those specified in this Statute unless the Governing Council finds, by a majority of two thirds of the votes cast, that these interfere with the objectives and tasks of the ESCB. Such functions shall be performed on the responsibility and liability of national central banks and shall not be regarded as being part of the functions of the ESCB.
That means the National Center Banks can do whatever the ECB can do—and even things it can’t.  The Greek central bank could step in and start issuing euros itself.  Again, there is precedent for this.  It was under Article 14.4 that the Irish Central Bank was able to print 80 billion euros as “emergency liquidity assistance,” and the Greek central bank has already printed 44 billion euros itself.

The Greek government could print euros, refinance its sovereign debt, and pay the interest to itself, effectively eliminating the interest burden.  Among other precedents, there is Canada, which borrowed from its own central bank from 1939 to 1974 to fund major infrastructure projects and social programs.  It pulled this off over a 25-year period without hyperinflating the currency, driving up prices, or increasing the public debt, which remained low and sustainable.

There is the concern that the euro might suffer by devaluation if other Eurozone members followed suit.  But Kesarios points to the Japanese experience, “where one can print and print and then print some more, without the value of the currency being marked down (due to positive trade flows).”   The euro might be equally resilient.

3.  Divorce: Just Walk Away

According to the May 29th New York Times, the 130 billion euro bailout that was supposed to buy time for Greece is now mainly just servicing the interest on the debt.  The “troika”—the ECB, IMF, and European Commission—which holds three-fourths of the debt, is sequestering the bailout funds to be paid right back to themselves in interest payments. This is merely going to compound the debt to disastrous levels, without a single cent going to the Greeks or their comatose economy.

Interest rates on Greek ten-year bonds have gone to nearly 30 percent recently.  Under the Rule of 72, at 30% compounded annually, debt doubles in 2.4 years.  If the Greeks can’t even pay the interest on the debt today except by borrowing, how are they going to repay double the principal in a mere 2.4 years?  At 30%, the Greeks could be paying over 100% of their GDP in interest charges.  Legally, a contract that is impossible to perform is void.

Alexis Tsipras, leader of the radical left-wing Greek party Syriza, which is now in second place in the Greek parliament, calls it an “odious debt,” a legal term for a national debt incurred by a regime for purposes that do not serve the best interests of the nation.  An odious debt under international law need not be repaid.

4.  Spousal Support: The Public Bank Option

If divorce is too much to contemplate, Greece’s crippling interest burden can be relieved by taking advantage of the ECB’s very generous 1% rate for bankers.  Article 123 of the Maastricht Treaty forbids member governments from borrowing directly from the ECB, but it makes an exception in paragraph 2 for “publicly-owned credit institutions”—something Greece will have plenty of when it nationalizes its banks.  They can line up at the ECB’s window for its bargain-basement 1% banking rate and use the borrowed funds to buy up the national debt.

Researcher Simon Thorpe wrote to the ECB and asked whether they would object if a publicly-owned credit institution were to borrow from the ECB and use the funds “to supply the money to a government such as the Greek government in order for that government to pay off its debts to financial markets.”  The ECB replied:
According to the Treaty—as you have just quoted—such publicly owned credit institutions “shall be given the same treatment by national central banks and the ECB as private credit institutions.”  It is up to the banks to decide how to use the money they have borrowed from the central bank system.
5.  The Dowry: Impose a Financial Transaction Tax

Thorpe notes that the ECB has issued and lent nearly one trillion euros to the banks at 1% since December 2011—three times the total Greek debt of 355 billion euros.  If Greek public banks borrowed from the ECB at 1% and bought Greece’s sovereign debt, the debt could be paid off in 10 years just from the returns on a very modest Financial Transaction Tax (FTT) of 0.3%.

Imposing a tiny FTT on all financial trades would not only be a lucrative source of revenue but would prevent the attacks of speculators, both on the newly-issued drachma and on the sovereign debt of Greece and other Eurozone countries.  The FTT has already been implemented in many countries.  In 2011, there were 40 countries that had FTT in operation, raising $38 billion (€29bn).

Where There Is a Will, There Is a Way

The problem is finding the will, particularly among the Eurocrat leaders holding the reins of power, who may not be looking for an amicable workout. The marital problems of Greece and the Eurozone stem from an arbitrary set of rules that were entered into and can be changed by agreement.   But as Mike Whitney maintained in a June 3 article titled “Europe Moves Closer to Banktatorship”:
These people are not interested in fixing the EZ economy. They are engaged in a stealth campaign to . . . solidify the power of big finance over the individual states . . . .
To avoid that dire scenario, the popular majority needs to grab the reins of power.  It is fitting that Greece, the birthplace of European culture and democracy, is the focus of the struggle against bondage to an elite banker class.  Greece can dance again if she can set herself free.

RICHARD CHARNIN EXPLAINS THAT THE U.S. EXIT POLLS ARE ALWAYS ADJUSTED (FORCED) TO MATCH THE OFFICIAL TALLY BY THE END OF ELECTION DAY, AT WHICH TIME THE ACTUAL EXIT POLL RESULTS DISAPPEAR. HOWEVER, DURING THE 2004 ELECTION THE ACTUAL DATA WERE FOUND ON THE INTERNET ALL DAY LONG AND 22 MINUTES INTO THE NEXT DAY, AT WHICH POINT KERRY WAS LEADING BUSH BY 51-47%. THE UNADJUSTED 2004 EXIT POLLS WERE FINALLY RELEASED A YEAR AGO, REVEALING THAT KERRY HAD ACTUALLY WON BY 51.7% TO 47.0% WITH 13660 RESPONDENTS (MORE THAN SUFFICIENT FOR STATISTICAL CONFIDENCE). THEN AS NOW THE MAINSTREAM MEDIA ABETED THE CRIME BY INSISTING ALL DAY LONG THAT "THE RACE IS TOO CLOSE TO CALL."

 facebook                                                                            Richard Charnin's page

The exit pollster's MO never changes. In the recall, the pundits said it was "too close to call". I’m quite sure that Barrett was winning, but the media knew the fix was in so they had to keep it close. They knew the actual exit poll numbers would not see the light of day. But they sure called it quickly for Walker, didn't they?

The pollster’s have had plenty of experience in adjusting exit polls to match the vote count.

In 2004, preliminary state exit poll numbers were downloaded from the CNN website by Jonathan Simon. Kerry led by 50-48%. The state polls were already in the process of being matched to the recorded vote. But Bush was winning the vote count - a massive divergence from the exit polls.

We later learned that Kerry led the National Exit Poll from 4pm to midnight. At 4pm (8349 respondents) he led by 51-48%. At 730 pm (11027 respondents) by 51-48%. At 1222am (13047) by 51-47%. But we didn’t see these numbers. They were not for public view.

The next day, the CNN and NYT websites showed that Bush won the National Exit Poll (13660) by 51-48% - matching the recorded vote. How did the final 613 National Exit Poll respondents enable Bush to flip the vote? The exit pollsters never could answer that one. After all, the flip was mathematically impossible.

The unadjusted 2004 exit polls (state and national) were not released until about a year ago, long after the damage was done. And guess what? Kerry actually won the 13660 respondents! He had 7064 (51.7%), Bush 6414 (47.0%), Other 182 (1.3%).

Someday, probably in 2022, we’ll get to see the unadjusted recall exit poll numbers. In the meantime, here's the 2004 National Exit Poll Timeline that was “not meant for public viewing”.

WISCONSIN'S RECALLED GOVERNOR SCOTT WALKER ATTRIBUTED HIS VICTORY TO VOTERS PREFERING "LEADERS WHO STAND UP AND MAKE TOUGH DECISIONS." (LIKE CUTTING THEIR SALARIES AND BENEFITS AND FIRING THEIR CHILDREN'S TEACHERS?) EVEN MORE IRONIC, WALKER'S OPPONENT BARRETT CONCEDED WITH THE COMMENT "WE HAVE SEEN THIS DEMOCRACY COME ALIVE." (LIKE DEMOCRACY IS YOUR RIGHT TO GO TO THE POLLS THINKING YOU ARE "THROWING THE BUM OUT" AND THEN ACCEPTING THAT YOUR VOTE MAY HAVE BEEN MISCOUNTED?) THERE IS VOLUMINOUS EVIDENCE THAT U.S. ELECTIONS ARE ROUTINELY RIGGED ...THAT IS IF YOU HAVE OTHER SOURCES OF NEWS THAN THE MAINSTREAM MEDIA. YET THIS TIME EVEN LIBERAL NEWS SOURCES LIKE DEMOCRACY NOW ATTRIBUTE WALKER'S UNEXPECTED WIN TO HIS SPENDING 7 TIMES AS MUCH MONEY AS HIS OPPONENT. NOW LET ME GET THIS STRAIGHT... IF I'M RECALLING A GOVERNOR BECAUSE HE IS SAVAGING MY STANDARD OF LIVING, AM I GOING TO BE SO DAZZLED BY HIS EXPENSIVE ATTACK ADS THAT I DECIDE TO KEEP HIM? TO ME WE HAVE JUST SEEN OUR DEMOCRACY *DIE*. DON'T THINK SO? READ BELOW AND WEEP.

Wisconsin Recall: The adjusted Final Exit Poll was forced to match an unlikely recorded vote

Richard Charnin |

June 6, 2012

The media and the exit pollsters have done it again.

Before the first votes were posted, the media reported that based on the exit polls, the election was “too close to call”. But Walker won by a solid 7% margin and 173,000 votes. Why the big red shift?

Why did the media not provide the actual unadjusted exit poll data (the “crosstabs”)? Was it because they knew that they would have to adjust the poll to match a bogus recorded vote and did not want the public to view the impossible “adjustments”?

The solid 53.2-46.3% Walker win was more than implausible since voter turnout exceeded that of the 2010 election. Walker “won” the recorded vote 52.2-46.6% in a supposed low-turnout election. But who turned out in droves in 2012? Democrats and independents who wanted Walker out. The grossly unpopular Walker could not have done better than he did in 2010 – only worse.

And as is always the case, there was no mention of the fraud factor in the mainstream media. There never is. To the exit pollsters and the media, there is no such thing as election fraud.

The GOP employs overt voter disenfranchisement in plain sight by robocalls, election workers discouraging voters from using paper ballots, etc. But we are supposed to believe that they would not covertly program the voting machines to flip votes from Barrett to Walker in cyberspace? And even if the machines are manufactured and programmed by right-wing organizations using unverifiable code.

The conventional wisdom is very conventional – and very misleading:

The NY Times Election site has the FINAL, adjusted exit poll crosstabs:
Here are just a few exit poll oddities:

1) A full 5% of voters were not white or black. But their vote is n/a.
2) Philosophy: 13% of liberals voted for Walker?
3) Party ID: 34% Democrat/ 35% Republican in a progressive state?
4) Labor: Just 62% voted for Barrett?
5) Obama preferred by 51-44%, yet Barrett lost the recall by 53.2-46.3%?
6) Barrett only got 81% of would-be Obama voters?
7) 47% voted for Walker in 2010 and just 34% for Barrett?
Walker only “won” by 52.2-46.6% in 2010.
8) Urban vote: Barrett gets just 62% in the big cities?

If we assume an equal 75% Obama and McCain voter turnout in the recall, a 50/50 split in new and returning third party voters, then in order to match the recorded vote, Walker needed 28% of returning Obama voters while Barrett had just 5% of returning McCain voters. That is a very implausible net 23% defection of Obama voters.

The True Vote Model indicates that Barrett should have won easily – assuming the caveat of a fair election. But the election was stolen. Its still the same old story – a case of do or die.

THE US GOVERNMENT, THE FED, AND WALL STREET MAY BE COLLUDING TO STAVE OFF A WORLD-WIDE SELL OFF OF US TREASURIES, LARGELY DUE TO THE 5 TOO-BIG-TO-FAIL US BANKS RUNNING UP DERIVATIVE BETS EQUAL TO 15 TIMES THE US GDP (AND MANY HUNDREDS OF TIMES THEIR RISK-BASED ASSETS). HERE PAUL CRAIG ROBERTS, PhD ECONOMIST AND FORMER ASSISTANT TREASURY SECRETARY FOR ECONOMIC POLICY UNDER REAGAN AND AN EDITOR OF THE WALL STREET JOURNAL, EXPLAINS THE CURRENT UNTENABLE US MONETARY POLICIES AND THE MANY POSSIBLE TRIGGERS FOR THE COLLAPSE OF THE DOLLAR AND THE HYPERINFLATION THAT WILL INEVITABLY RESULT.

Collapse At Hand

Ever since the beginning of the financial crisis and quantitative easing, the question has been before us: How can the Federal Reserve maintain zero interest rates for banks and negative real interest rates for savers and bond holders when the US government is adding $1.5 trillion to the national debt every year via its budget deficits? Not long ago the Fed announced that it was going to continue this policy for another 2 or 3 years. Indeed, the Fed is locked into the policy. Without the artificially low interest rates, the debt service on the national debt would be so large that it would raise questions about the US Treasury’s credit rating and the viability of the dollar, and the trillions of dollars in Interest Rate Swaps and other derivatives would come unglued.

In other words, financial deregulation leading to Wall Street’s gambles, the US government’s decision to bail out the banks and to keep them afloat, and the Federal Reserve’s zero interest rate policy have put the economic future of the US and its currency in an untenable and dangerous position. It will not be possible to continue to flood the bond markets with $1.5 trillion in new issues each year when the interest rate on the bonds is less than the rate of inflation. Everyone who purchases a Treasury bond is purchasing a depreciating asset. Moreover, the capital risk of investing in Treasuries is very high. The low interest rate means that the price paid for the bond is very high. A rise in interest rates, which must come sooner or later, will collapse the price of the bonds and inflict capital losses on bond holders, both domestic and foreign.

The question is: when is sooner or later? The purpose of this article is to examine that question.

Let us begin by answering the question: how has such an untenable policy managed to last this long?

A number of factors are contributing to the stability of the dollar and the bond market. A very important factor is the situation in Europe. There are real problems there as well, and the financial press keeps our focus on Greece, Europe, and the euro. Will Greece exit the European Union or be kicked out? Will the sovereign debt problem spread to Spain, Italy, and essentially everywhere except for Germany and the Netherlands?

Will it be the end of the EU and the euro? These are all very dramatic questions that keep focus off the American situation, which is probably even worse.

The Treasury bond market is also helped by the fear individual investors have of the equity market, which has been turned into a gambling casino by high-frequency trading.

High-frequency trading is electronic trading based on mathematical models that make the decisions. Investment firms compete on the basis of speed, capturing gains on a fraction of a penny, and perhaps holding positions for only a few seconds. These are not long-term investors. Content with their daily earnings, they close out all positions at the end of each day.

High-frequency trades now account for 70-80% of all equity trades. The result is major heartburn for traditional investors, who are leaving the equity market. They end up in Treasuries, because they are unsure of the solvency of banks who pay next to nothing for deposits, whereas 10-year Treasuries will pay about 2% nominal, which means, using the official Consumer Price Index, that they are losing 1% of their capital each year. Using John Williams’ (shadowstats.com) correct measure of inflation, they are losing far more. Still, the loss is about 2 percentage points less than being in a bank, and unlike banks, the Treasury can have the Federal Reserve print the money to pay off its bonds. Therefore, bond investment at least returns the nominal amount of the investment, even if its real value is much lower. (For a description of High-frequency trading, see: http://en.wikipedia.org/wiki/High_frequency_trading )

The presstitute financial media tells us that flight from European sovereign debt, from the doomed euro, and from the continuing real estate disaster into US Treasuries provides funding for Washington’s $1.5 trillion annual deficits. Investors influenced by the financial press might be responding in this way. Another explanation for the stability of the Fed’s untenable policy is collusion between Washington, the Fed, and Wall Street. We will be looking at this as we progress.

Unlike Japan, whose national debt is the largest of all, Americans do not own their own public debt. Much of US debt is owned abroad, especially by China, Japan, and OPEC, the oil exporting countries. This places the US economy in foreign hands. If China, for example, were to find itself unduly provoked by Washington, China could dump up to $2 trillion in US dollar-dominated assets on world markets. All sorts of prices would collapse, and the Fed would have to rapidly create the money to buy up the Chinese dumping of dollar-denominated financial instruments.

The dollars printed to purchase the dumped Chinese holdings of US dollar assets would expand the supply of dollars in currency markets and drive down the dollar exchange rate. The Fed, lacking foreign currencies with which to buy up the dollars would have to appeal for currency swaps to sovereign debt troubled Europe for euros, to Russia, surrounded by the US missile system, for rubles, to Japan, a country over its head in American commitment, for yen, in order to buy up the dollars with euros, rubles, and yen.

These currency swaps would be on the books, unredeemable and making additional use of such swaps problematical. In other words, even if the US government can pressure its allies and puppets to swap their harder currencies for a depreciating US currency, it would not be a repeatable process. The components of the American Empire don’t want to be in dollars any more than do the BRICS.

However, for China, for example, to dump its dollar holdings all at once would be costly as the value of the dollar-denominated assets would decline as they dumped them. Unless China is faced with US military attack and needs to defang the aggressor, China as a rational economic actor would prefer to slowly exit the US dollar. Neither do Japan, Europe, nor OPEC wish to destroy their own accumulated wealth from America’s trade deficits by dumping dollars, but the indications are that they all wish to exit their dollar holdings.

Unlike the US financial press, the foreigners who hold dollar assets look at the annual US budget and trade deficits, look at the sinking US economy, look at Wall Street’s uncovered gambling bets, look at the war plans of the delusional hegemon and conclude: “I’ve got to carefully get out of this.”

US banks also have a strong interest in preserving the status quo. They are holders of US Treasuries and potentially even larger holders. They can borrow from the Federal Reserve at zero interest rates and purchase 10-year Treasuries at 2%, thus earning a nominal profit of 2% to offset derivative losses. The banks can borrow dollars from the Fed for free and leverage them in derivative transactions. As Nomi Prins puts it, the US banks don’t want to trade against themselves and their free source of funding by selling their bond holdings. Moreover, in the event of foreign flight from dollars, the Fed could boost the foreign demand for dollars by requiring foreign banks that want to operate in the US to increase their reserve amounts, which are dollar based.

I could go on, but I believe this is enough to show that even actors in the process who could terminate it have themselves a big stake in not rocking the boat and prefer to quietly and slowly sneak out of dollars before the crisis hits. This is not possible indefinitely as the process of gradual withdrawal from the dollar would result in continuous small declines in dollar values that would end in a rush to exit, but Americans are not the only delusional people.

The very process of slowly getting out can bring the American house down. The BRICS–Brazil, the largest economy in South America, Russia, the nuclear armed and energy independent economy on which Western Europe (Washington’s NATO puppets) are dependent for energy, India, nuclear armed and one of Asia’s two rising giants, China, nuclear armed, Washington’s largest creditor (except for the Fed), supplier of America’s manufactured and advanced technology products, and the new bogyman for the military-security complex’s next profitable cold war, and South Africa, the largest economy in Africa–are in the process of forming a new bank. The new bank will permit the five large economies to conduct their trade without use of the US dollar.

In addition, Japan, an American puppet state since WWII, is on the verge of entering into an agreement with China in which the Japanese yen and the Chinese yuan will be directly exchanged. The trade between the two Asian countries would be conducted in their own currencies without the use of the US dollar. This reduces the cost of foreign trade between the two countries, because it eliminates payments for foreign exchange commissions to convert from yen and yuan into dollars and back into yen and yuan.

Moreover, this official explanation for the new direct relationship avoiding the US dollar is simply diplomacy speaking. The Japanese are hoping, like the Chinese, to get out of the practice of accumulating ever more dollars by having to park their trade surpluses in US Treasuries. The Japanese US puppet government hopes that the Washington hegemon does not require the Japanese government to nix the deal with China.

Now we have arrived at the nitty and gritty. The small percentage of Americans who are aware and informed are puzzled why the banksters have escaped with their financial crimes without prosecution. The answer might be that the banks “too big to fail” are adjuncts of Washington and the Federal Reserve in maintaining the stability of the dollar and Treasury bond markets in the face of an untenable Fed policy.

Let us first look at how the big banks can keep the interest rates on Treasuries low, below the rate of inflation, despite the constant increase in US debt as a percent of GDP–thus preserving the Treasury’s ability to service the debt.

The imperiled banks too big to fail have a huge stake in low interest rates and the success of the Fed’s policy. The big banks are positioned to make the Fed’s policy a success. JPMorgan Chase and other giant-sized banks can drive down Treasury interest rates and, thereby, drive up the prices of bonds, producing a rally, by selling Interest Rate Swaps (IRSwaps).

A financial company that sells IRSwaps is selling an agreement to pay floating interest rates for fixed interest rates. The buyer is purchasing an agreement that requires him to pay a fixed rate of interest in exchange for receiving a floating rate.

The reason for a seller to take the short side of the IRSwap, that is, to pay a floating rate for a fixed rate, is his belief that rates are going to fall. Short-selling can make the rates fall, and thus drive up the prices of Treasuries. When this happens, as these charts illustrate, there is a rally in the Treasury bond market that the presstitute financial media attributes to “flight to the safe haven of the US dollar and Treasury bonds.” In fact, the circumstantial evidence (see the charts in the link above) is that the swaps are sold by Wall Street whenever the Federal Reserve needs to prevent a rise in interest rates in order to protect its otherwise untenable policy. The swap sales create the impression of a flight to the dollar, but no actual flight occurs. As the IRSwaps require no exchange of any principal or real asset, and are only a bet on interest rate movements, there is no limit to the volume of IRSwaps.

This apparent collusion suggests to some observers that the reason the Wall Street banksters have not been prosecuted for their crimes is that they are an essential part of the Federal Reserve’s policy to preserve the US dollar as world currency. Possibly the collusion between the Federal Reserve and the banks is organized, but it doesn’t have to be. The banks are beneficiaries of the Fed’s zero interest rate policy. It is in the banks’ interest to support it. Organized collusion is not required.

Let us now turn to gold and silver bullion. Based on sound analysis, Gerald Celente and other gifted seers predicted that the price of gold would be $2000 per ounce by the end of last year. Gold and silver bullion continued during 2011 their ten-year rise, but in 2012 the price of gold and silver have been knocked down, with gold being $350 per ounce off its $1900 high.

In view of the analysis that I have presented, what is the explanation for the reversal in bullion prices? The answer again is shorting. Some knowledgeable people within the financial sector believe that the Federal Reserve (and perhaps also the European Central Bank) places short sales of bullion through the investment banks, guaranteeing any losses by pushing a key on the computer keyboard, as central banks can create money out of thin air.

Insiders inform me that as a tiny percent of those on the buy side of short sells actually want to take delivery on the gold or silver bullion, and are content with the financial money settlement, there is no limit to short selling of gold and silver. Short selling can actually exceed the known quantity of gold and silver.

Some who have been watching the process for years believe that government-directed short-selling has been going on for a long time. Even without government participation, banks can control the volume of paper trading in gold and profit on the swings that they create. Recently short selling is so aggressive that it not merely slows the rise in bullion prices but drives the price down. Is this aggressiveness a sign that the rigged system is on the verge of becoming unglued?

In other words, “our government,” which allegedly represents us, rather than the powerful private interests who elect “our government” with their multi-million dollar campaign contributions, now legitimized by the Republican Supreme Court, is doing its best to deprive us mere citizens, slaves, indentured servants, and “domestic extremists” from protecting ourselves and our remaining wealth from the currency debauchery policy of the Federal Reserve. Naked short selling prevents the rising demand for physical bullion from raising bullion’s price.

Jeff Nielson explains another way that banks can sell bullion shorts when they own no bullion. (See, http://www.gold-eagle.com/editorials_08/nielson102411.html) Nielson says that JP Morgan is the custodian for the largest long silver fund while being the largest short-seller of silver. Whenever the silver fund adds to its bullion holdings, JP Morgan shorts an equal amount. The short selling offsets the rise in price that would result from the increase in demand for physical silver. Nielson also reports that bullion prices can be suppressed by raising margin requirements on those who purchase bullion with leverage. The conclusion is that bullion markets can be manipulated just as can the Treasury bond market and interest rates.

How long can the manipulations continue? When will the proverbial hit the fan?
If we knew precisely the date, we would be the next mega-billionaires.

Here are some of the catalysts waiting to ignite the conflagration that burns up the Treasury bond market and the US dollar:

A war, demanded by the Israeli government, with Iran, beginning with Syria, that disrupts the oil flow and thereby the stability of the Western economies or brings the US and its weak NATO puppets into armed conflict with Russia and China. The oil spikes would degrade further the US and EU economies, but Wall Street would make money on the trades.

An unfavorable economic statistic that wakes up investors as to the true state of the US economy, a statistic that the presstitute media cannot deflect.

An affront to China, whose government decides that knocking the US down a few pegs into third world status is worth a trillion dollars.

More derivative mistakes, such as JPMorgan Chase’s recent one, that send the US financial system again reeling and reminds us that nothing has changed.

The list is long. There is a limit to how many stupid mistakes and corrupt financial policies the rest of the world is willing to accept from the US. When that limit is reached, it is all over for “the world’s sole superpower” and for holders of dollar-denominated instruments.

Financial deregulation converted the financial system, which formerly served businesses and consumers, into a gambling casino where bets are not covered. These uncovered bets, together with the Fed’s zero interest rate policy, have exposed Americans’ living standard and wealth to large declines. Retired people living on their savings and investments, IRAs and 401(k)s can earn nothing on their money and are forced to consume their capital, thereby depriving heirs of inheritance. Accumulated wealth is consumed.

As a result of jobs offshoring, the US has become an import-dependent country, dependent on foreign made manufactured goods, clothing, and shoes. When the dollar exchange rate falls, domestic US prices will rise, and US real consumption will take a big hit. Americans will consume less, and their standard of living will fall dramatically.

The serious consequences of the enormous mistakes made in Washington, on Wall Street, and in corporate offices are being held at bay by an untenable policy of low interest rates and a corrupt financial press, while debt rapidly builds. The Fed has been through this experience once before. During WW II the Federal Reserve kept interest rates low in order to aid the Treasury’s war finance by minimizing the interest burden of the war debt. The Fed kept the interest rates low by buying the debt issues. The postwar inflation that resulted led to the Federal Reserve-Treasury Accord in 1951, in which agreement was reached that the Federal Reserve would cease monetizing the debt and permit interest rates to rise.

Fed chairman Bernanke has spoken of an “exit strategy” and said that when inflation threatens, he can prevent the inflation by taking the money back out of the banking system. However, he can do that only by selling Treasury bonds, which means interest rates would rise. A rise in interest rates would threaten the derivative structure, cause bond losses, and raise the cost of both private and public debt service. In other words, to prevent inflation from debt monetization would bring on more immediate problems than inflation. Rather than collapse the system, wouldn’t the Fed be more likely to inflate away the massive debts?

Eventually, inflation would erode the dollar’s purchasing power and use as the reserve currency, and the US government’s credit worthiness would waste away. However, the Fed, the politicians, and the financial gangsters would prefer a crisis later rather than sooner. Passing the sinking ship on to the next watch is preferable to going down with the ship oneself. As long as interest rate swaps can be used to boost Treasury bond prices, and as long as naked shorts of bullion can be used to keep silver and gold from rising in price, the false image of the US as a safe haven for investors can be perpetrated.

However, the $230,000,000,000,000 in derivative bets by US banks might bring its own surprises. JPMorgan Chase has had to admit that its recently announced derivative loss of $2 billion is more than that. How much more remains to be seen. According to the Comptroller of the Currency http://www.occ.treas.gov/topics/capital-markets/financial-markets/trading/derivatives/dq411.pdf the five largest banks hold 95.7% of all derivatives. The five banks holding $226 trillion in derivative bets are highly leveraged gamblers. For example, JPMorgan Chase has total assets of $1.8 trillion but holds $70 trillion in derivative bets, a ratio of $39 in derivative bets for every dollar of assets. Such a bank doesn’t have to lose very many bets before it is busted.

Assets, of course, are not risk-based capital. According to the Comptroller of the Currency report, as of December 31, 2011, JPMorgan Chase held $70.2 trillion in derivatives and only $136 billion in risk-based capital. In other words, the bank’s derivative bets are 516 times larger than the capital that covers the bets.

It is difficult to imagine a more reckless and unstable position for a bank to place itself in, but Goldman Sachs takes the cake. That bank’s $44 trillion in derivative bets is covered by only $19 billion in risk-based capital, resulting in bets 2,295 times larger than the capital that covers them.

Bets on interest rates comprise 81% of all derivatives. These are the derivatives that support high US Treasury bond prices despite massive increases in US debt and its monetization.

US banks’ derivative bets of $230 trillion, concentrated in five banks, are 15.3 times larger than the US GDP. A failed political system that allows unregulated banks to place uncovered bets 15 times larger than the US economy is a system that is headed for catastrophic failure. As the word spreads of the fantastic lack of judgment in the American political and financial systems, the catastrophe in waiting will become a reality.

Everyone wants a solution, so I will provide one. The US government should simply cancel the $230 trillion in derivative bets, declaring them null and void. As no real assets are involved, merely gambling on notional values, the only major effect of closing out or netting all the swaps (mostly over-the-counter contracts between counter-parties) would be to take $230 trillion of leveraged risk out of the financial system. The financial gangsters who want to continue enjoying betting gains while the public underwrites their losses would scream and yell about the sanctity of contracts. However, a government that can murder its own citizens or throw them into dungeons without due process can abolish all the contracts it wants in the name of national security. And most certainly, unlike the war on terror, purging the financial system of the gambling derivatives would vastly improve national security.

Bilderberg Meeting a Wrap, Who Would Trust these People?

By Michael Collins (about author)

opednews.com

(Chantilly, VA 6/3/2012) The Bilderberg Group completed its annual meeting today in Northern Virginia. The group was founded in 1954 by the financial, political, and military elites of Europe and the United States. Annual meetings provide for "regular, off-the-record discussions [to] help create a better understanding of the complex forces and major trends affecting Western nations in the difficult post-war period." Bilderberg Meetings, Official Website

The inherent contradiction in this mission statement is glaringly obvious. These are the very same people who put in place and control the governments and programs that they're meeting in private to "discuss." Don't they discuss these things before and during their masquerade of governance?

The group's official meeting website says, "What is unique about Bilderberg as a forum is the privacy of the meetings, which has no purpose other than to allow participants to speak their minds openly and freely."

When the world's ultra-rich and powerful meet to address major sociopolitical problems in a forum based on privacy, it's time to take a closer look.

Trust the Bilderberg Group at your own peril

This group represents what Steve Hynd of The Agonist calls the top 0.001% on the wealth pyramid. They have all the levers of power. The heads of the major US-European central banks are permanent members. The Federal Reserve's Ben Bernanke and curmudgeon in chief Paul Volker are made men. Mega corporations are there too. Bill Gates of Microsoft and Jeff Bezos of Amazon are representatives for the United States. The Europeans have BP's former and current chairmen, the head of Royal Dutch Shell, plus major manufacturing companies like Fiat, Unilever, and the French and Italian Telecoms. David Rockefeller, of Chase banking, is the group's
éminence grise.

What's the track record of the group? Look around and you'll see the product of their control and leadership, as it were. The world's economy is disjointed and failing in nearly every corner except Asia. Plans are already in place for massive security problems created by the collapse of just about every vital element of the planet's ecology during the group's watch. The latest venture of spreading democracy and capitalism, the Arab Spring, is an utter failure. Libya, Tunisia, and Egypt are arguably less free in a number of ways. There is no argument that the economies of the three nations are much worse off thanks to the efforts NATO, the military arm of these individuals and inerests.

Individual members have a sorry track record as well. The central bankers are struggling as evidenced by the faltering Eurozone and US economies. Deutsche Bank's Josef Ackermann was a key player in the European response to Greece's troubles. That's certainly worked out well. US Treasury Secretary Tim Geithner presided over the greatest wealth transfer in history enabled by massive bailouts for Wall Street and big bank interests. Federal Reserve Chairman Ben Bernanke got the Fed lending rate to nearly zero percent for the big banks while failing to notice that those banks were routinely charging 25% interest to credit card holders. These folks are not the sharpest tools in the shed when it comes to helping the people.

Who would trust them? Can we survive much more of their bad judgment and disastrous management?

Bilderberg's more sinister side contributed directly to the numerous theories that see the group as a diabolic international conspiracy. In my opinion, the Bilderberg group is the gang that couldn't shoot straight, a self-appointed hapless collection of incompetents with all the power required to solve major problems but none of the intellect, discipline, and moral sensibility required to get the job done.

In addition to incompetence, there are clear examples of sociopathic behavior by group members. Henry Kissinger allowed the ravaging of East Timor in return for a few favors from Indonesia. His failures in Vietnam caused hundreds of thousands to die needlessly. Colin Powell lied about weapons of mass destruction before the United Nations to get his boss the war he wanted. George H.W. Bush and Bill Clinton 1990's sanctions against Iraq resulted in the deaths of around a quarter million Iraqi children under five.

The baddest Bilderberger of all time

Former Chairman of the Joint Chiefs of Staff, Admiral Lyman Lemnitzer, is the Bilderberg member who has done more for both accurate and unfounded conspiracy theories than any of his peers.
In 1962, Lemnitzer approved Justification for U.S. Military Intervention in Cuba, also known as Operation Northwoods . The plan was declassified in 1997 by the John F. Kennedy Assassination Records Review Board.

The chiefs were upset that they lacked the option of invading Communist Cuba. As an alternative, they came up with Northwoods, a false flag operation that would provide the excuse required to invade Cuba. Northwoods was presented to and rejected by President John F. Kennedy in 1962. The material below is from that original plan.

One feature of the plan called for recruiting Cuban exiles to don official Cuban military uniforms, storm the Guantanamo Bay base, set some fires, etc. and then get caught. This operation was intended to show that Cuba was a threat to the United States.

While a fake battle was taking place between US provocateurs and uniformed military, Miami and other U.S. cities would be subjected to false flag terrorist attacks by another set of agents working for the joint chiefs. These terrorists were to be tied directly to Fidel Castro.

A "drone" ship would be destroyed and a remote controlled aircraft, masquerading as a charter flight with real people aboard, would be shot down with the blame falling on Castro's Cuba.

When Lemnitzer presented the plan, he was removed as head of the joint chiefs and given the command of NATO.  Lest than a year later,  he was invited to join the Bilderberg group.

This plan represents treason at the highest levels. No one was punished. Outside of the authors and a few elected officials, no one was told about this episode of madness. Lemnitzer joined the Bilderberg Group in 1963.

It's no wonder"

It is no wonder that people aware of Northwoods and other control schemes interpret manipulative and malicious intent behind government actions. For years, the CIA's MKULTRA program experimented on citizens to develop mind control techniques. Operation Mockingbird allowed the CIA to dictate content for news and opinion pieces by prominent journalists. That project began in 1948 and was supposedly shut down I 1976. (With today's corporate media, the project is likely unnecessary.)

Protesters showed up for an Occupy Bilderberg event at the 2012 meeting in Chantilly. Alex Jones and Mark Dice of Infowars.com were there to provide extensive coverage of the event. Supporters included loyal readers of Infowars, some Ron Paul supporters, and other sympathizers.

Jones and Dice see an evil genius behind the group with an interlocking relationship with the other secret groups like the Illuminati and the Bohemian Grove revelers.
I agree that whenever these individuals and interests get together, trouble will follow. Attempts at secrecy only compound the problem

The real problems, however, are presented to us in very visible ways year after year. The elite, also known as The Money Party, make no secret of taking as much wealth as possible from those without political control. It never occurs to them that the more people they impoverish, the less vibrant the market will be for their goods and services. The elite engage in endless wars that slaughter hundreds of thousands and lead to social regression. It never occurs to them that there is a price for this paid in human suffering.

The very fact that the secret meeting is announced with its own web site shows just how decadent the ruling class has become.  They can't even manage a secret meeting in secret.

DO REPUBLICAN REPRESENTATIVES ELECTED FROM THE RANKS OF THE TEA PARTY KEEP THEIR PROMISES TO THOSE WHO ELECTED THEM? NOPE!

Cenk Ugyur & Josh Israel Talk About The Tea Party Bankrolling

http://www.youtube.com/watch?v=HgQGGDOdYIU&feature=colike

Published on May 22, 2012 by

www.thinkprogress.org

By Josh Israel and Adam Peck on May 21, 2012 at 3:45 pm

The 15 freshmen Republican representatives in the House Tea Party Caucus each ran in 2010 on a populist anti-Wall Street message, highlighting their opposition to bank bailouts like the 2008 Troubled Asset Relief Program (TARP) and criticizing Washington for enabling the banking sector as it became "Too Big to Fail." After winning, all fifteen received significant PAC contributions from the banking industry — and have become a reliable vote and mouthpiece for the financial industry, a ThinkProgress analysis of campaign contributions, voting records and public statements reveals.

Rather than campaigning on a typical pro-business platform, the Tea Party freshmen tapped into public resentment of big banks and bailouts. For example, then-candidate Sandy Adams (R-FL) said on her campaign website that she "opposes government bailouts" and "would have voted against TARP and the auto bailout." Jeff Landry (R-LA) said bailouts of private businesses had "corrupted our free market system by rewarding the irresponsible and penalizing the responsible," blasting "bank bailouts, which led to taxpayer money directly or indirectly going into multi-million dollar bonuses."

But in Congress, the Tea Party has toed the line for big banks. Eleven of the 15 have become co-sponsors of H.R. 3461, a top priority for the ABA. According to Americans for Financial Reform, the legislation would "tilt the playing field further in the direction of excessive deference to industry interests and tie the hands of regulators attempting to protect the public interest." The bill would make it harder for bank examiners to do their job, giving regulatory responsibilities to an industry that's already shown it can't police itself.

The lone Tea Party freshman member of the Financial Services Committee, Rep. Stephen Fincher (R-TN), has consistently voted with the industry and the Republican majority for weaker regulation of the sector.

And of the 15, all but McKinley and Rep. Tim Huelskamp (R-KS) voted for the GOP's 2013 budget proposal, which included the repeal of a key component of the financial sector regulation.

Their rhetoric has also become extremely friendly to the financial industry. Rep. Joe Walsh (R-IL) famously yelled at a constituent: "Don't blame banks, and don't blame the marketplace for the mess we're in right now! I am tired of hearing that crap! This pisses me off!" Rep. Diane Black (R-TN) bashed financial regulations as "part of a pattern of government interference in the private sector." Rep. Blake Fahrenthold (R-TX) warned "excessive regulations will hurt our financial institutions." Rep. David McKinley (R-WV) said that by regulating banking and financial institutions, "what they're doing is getting into our lives. And many of us are trying to find a way to get them to pull back." And several of the freshmen criticized Dodd-Frank's regulations for limiting credit availability for small businesses.

Bill Black on “Career Limiting Gestures”

Bill Black on being “disinvited” to brief Congress because he might “bash the banks”

More at The Real News

Precis

I’ve just been definitively disinvited, for the second time in my career, from briefing members of Congress (in this case, about derivatives) on the grounds that they fear “bank bashing”.

By Bill Black

When I was the Deputy Director of FSLIC, House Banking Committee Chairman St Germain was helping Speaker Wright hold the FSLIC recapitalization bill hostage to extort favors for Texas control frauds, including Don Dixon’s Vernon Savings (which was providing prostitutes to the State of Texas’ top S&L regulator and was building towards having 96% of its ADC loans in default – which is why we referred to it as “Vermin”). The attack on our agency was that we were mad dogs biased against Texas S&Ls and causing the Texas crisis by closing too many insolvent but well-run Texas S&Ls. Our response had many elements, but one of our principal points was that the Texas S&Ls we were closing were typically control frauds. At this juncture, St Germain’s staffers made a mistake. They requested that we testify on a host of issues, but the invite letter had a zinger, premised on an article saying that the Feds were slow to prosecute frauds in the Southwest. The invite specifically called for us to respond and discuss the role of fraud in the Southwest. We used the opportunity to explain the extensive role of fraud in Texas S&L failures.

The day of the hearing, I walked toward the witness table, but was called over by St Germain’s chief of staff. He proceeded to disinvite us from testifying on the grounds that we had filed non-responsive testimony. (We had, of course, responded to every inquiry they made. They simply hated the response because we documented the enormous role that control fraud was playing in causing Texas S&Ls to fail.)

Today, I received definitive word that I had been disinvited from a bipartisan briefing of members of Congress on the subject of financial derivatives. I have deleted the name of the staffer because he is not the issue. The relevant email thread is below.

The member of Congress putting the event together is one of the strongest advocates of the need for banking reform. I have assisted the Member’s staff in the past in such efforts. The Member’s chief of staff called me today. His position is that I was never invited to participate and that it was unfortunate that I booked the flights and put UMKC on the hook for the non-refundable fares and hotel before informing his office that I was accepting their inquiry about participation (as opposed to invitation). He explains that it is impossible physically to have me participate and that the decision not to have me participate has nothing to do with concerns about “balance” or “bank bashing.” I emphasize also that, unlike St Germain’s disinvitation the email thread states an interest in inviting me to speak at future briefings. I hope that such invitations will be made. The Member and the Member’s staff were polite while St Germain’s chief of staff was deliberately rude.

Nevertheless, I think that the Chief of Staff’s phone call to me explaining their view that I was never invited makes my point. We all know that is simple to add a panelist. What is really going on is that things are so toxic in Congress now, and the largest banks are so sensitive to any criticism, that the progressives fear that any criticism of bank practices that will cause the next financial crisis will be considered “bank bashing” and will cause Republicans to be unwilling to participate. The fact that I have a 30 year record of non-partisan service to the nation on banking matters, including service as a banker with the Federal Home Loan Bank of San Francisco, does not count in such a world. We must not speak uncomfortable truths to power. You will see that it is his staff that informed me that the concerns that prevented me from joining the panel were maintaining a “consensus” about the panel’s “balance” and avoiding “bank bashing.”

I remain supportive, of course, of members of Congress reaching out and getting facts about our financial system, so I hope that the Member’s efforts to create a series of bipartisan briefings succeed. Self-censorship, however, is most debilitating form of censorship. A “consensus” that seeks to minimize any criticism of the “too big to fail” banks on the grounds that criticism equates to “bank bashing” is a consensus to play ostrich.

I am pleased to accept your invitation to participate on the panel. My cell is [redacted]. I’ll be flying in from California. Please send me information on logistics/venue etc. as soon as you have more details.
Best, Bill
Best regards,

May 25, 2012 10:36 a.m.

I want to sincerely thank you for your willingness to participate and contribute to the discussion. Unfortunately, we cannot add any additional participants to the panel. In efforts to proceed in a bipartisan manner, we have achieved a nice balance of individuals who will accommodate various points of views on derivatives regulations. Accordingly, adding another participant at this time would disrupt that balance and will spark concerns with our Republican colleagues.
I apologize for any inconvenience this may have caused, but I do hope you will consider joining us for the next panel we are convening to discuss the Volcker Rule. Next week’s panel is intended to be the first in a series and I intend to reach out to you again and Mr. Greenberg.
Thanks again for your assistance and the resources you provided earlier in the week. And I hope you enjoy the Memorial Day weekend.

Best regards,

FYI, I have testified to Congress five times about this crisis and two of those appearances (once in each chamber) were as the Republican designated witness so I won’t throw off any bipartisan balance—quite the opposite.

In case you did not receive my voice message I wanted to once again apologize for any incovenience you may have incurred and thank you for your willingness to participate. As I mentioned before, in the time between my initial call to your office and when we spoke last week, I had confirmed the participation of several others who agreed to do so under the understanding that the panel would be bipartisan and non confrontational. Quite frankly, many of the trade associations were hesitant to speak in public because of what they thought would be a public ‘bank bashing.’ So for this initial panel, we have tread carefully because we want Republican participation and we want to keep these forums ongoing. It is my hope that your colleagues and university will understand that we tried to accomodate another participant, but we just could not make it work without disrupting consensus. I will be in touch with you regarding the next panel we are organizing to discuss the Volcker Rule.

Tuesday 5/29/12 10:41 a.m.

Unfortunately, we cannot accommodate an additional participant. I understand and appreciate your experience, but the factors I outlined in the previous email still exist and this change would compromise the consensus we have achieved. I do wish you would have confirmed your availability with me before making arrangements. When we last spoke, it was my understanding that you had to check your schedule first. So I was a little surprised that you were so quickly able to clear your schedule and make flight arrangements before we had a follow-up conversation. In any event, your previous work as a regulator during the S&L crisis is highly noted and I do think your primary knowledge and insight is helpful as Congress and the agencies grapple with the 21st century financial regulation. To that end, I do hope you will consider participation in the follow up panel, and I sincerely apologize for any inconvenience you have incurred.

Best, Bill Black

He was the Executive Director of the Institute for Fraud Prevention from 2005-2007. He has taught previously at the LBJ School of Public Affairs at the University of Texas at Austin and at Santa Clara University, where he was also the distinguished scholar in residence for insurance law and a visiting scholar at the Markkula Center for Applied Ethics. Black was litigation director of the Federal Home Loan Bank Board, deputy director of the FSLIC, SVP and general counsel of the Federal Home Loan Bank of San Francisco, and senior deputy chief counsel, Office of Thrift Supervision. He was deputy director of the National Commission on Financial Institution Reform, Recovery and Enforcement. Black developed the concept of "control fraud" -- frauds in which the CEO or head of state uses the entity as a "weapon." Control frauds cause greater financial losses than all other forms of property crime combined. He recently helped the World Bank develop anti-corruption initiatives and served as an expert for OFHEO in its enforcement action against Fannie Mae's former senior management.
